Terms of Service (Public Offer)
This is a translation for convenience. The Ukrainian version is the binding one.
1. What this document is
1.1. These Terms are a public offer (Civil Code of Ukraine, arts. 633 and 641) from the seller named in section 17 ("we", "PlainApply") to any person ("you") to use the PlainApply service at plainapply.com on the conditions below. The conditions are the same for everyone.
1.2. You accept this offer, and a contract is concluded between us in electronic form (Law of Ukraine "On Electronic Commerce"), when, after signing in, you press "Accept and continue" on the screen that links to these Terms (Article 11(6) of that Law: an action whose meaning is clearly explained on the screen). We record which edition you accepted and when. Using PlainApply as a guest without an account is also governed by these Terms.
1.3. The Ukrainian version of these Terms is the original. The English version is a translation for convenience. If they differ, the Ukrainian version prevails.
1.4. We keep every version of these Terms and record which version you accepted and when.
1.5. These Terms include, by reference, the Privacy Policy, the Refund Policy and the Acceptable Use Policy.
2. Words we use
- Search — one job-hunting goal you pursue, e.g. "Flutter developer".
- Vacancy — the details of one job opening you add.
- Application — your attempt to get one Vacancy within one Search.
- Base CV — the CV a Search starts from. Tailored CV — a copy of a Base CV adapted to one Vacancy.
- ATS Check — a report showing what an applicant-tracking system would likely extract from a CV and which Vacancy keywords are missing.
- AI action — an action that uses an artificial-intelligence model: ATS Check, Fit to Vacancy, Translate CV, Generate CV, AI "improve section", Vacancy capture.
- Credit — a prepaid unit that pays for one AI action run on PlainApply's AI. Credits never expire.
- Pass — a one-time purchase of a week or a month of AI actions run with your Own AI Key. A Pass never renews automatically.
- Own AI Key — your API key for a supported AI provider, which you store in PlainApply so a Pass can run AI actions on your provider account.
3. The service
3.1. PlainApply is software that helps you write, check and improve your own CV — or, with their permission, someone else's — and track job applications. It includes a CV editor, PDF export, CV upload, ATS Check, AI actions, Searches, an Application tracker, reminders and data import and export.
3.2. PlainApply is not a recruitment agency, job board or employment service. We do not send your CV to employers, do not find jobs for you and do not act for you.
3.3. What is free, what is paid and the free-tier limits are listed on the pricing page. We may change free features and limits for the future; we will not take away anything you have already paid for.
3.4. We may update, add or remove features. If a change removes a paid feature you have unused Credits or an active Pass for, you may ask for a refund of what is unused (see section 7).
4. Your account
4.1. Age. You may use PlainApply from 16 years of age. You may pay from 18 years of age, or younger with the consent of a parent or guardian.
4.2. You sign in with Google or a one-time link sent to your email. Keep access to that email secure: whoever controls it controls your account.
4.3. Accounts cannot be transferred, sold or rented out.
4.4. Some free features (for example the free ATS Check) are available only for accounts with a permanent, verified email address.
5. Paid services: Credits and Passes
5.1. Nature. Credits and Passes are prepayment for a service — running AI actions. They are not a subscription, a licence, money or electronic money. They cannot be exchanged for cash (except through a refund under section 7), transferred to another account or resold.
5.2. Prices. Current prices are on the pricing page. For payments through Monobank (section 6) prices are in Ukrainian hryvnia (UAH). The seller is not a VAT payer; the price shown is the final price. Your bank may charge its own fees, for example for currency conversion.
5.3. Credits.
- Each AI action shows its cost in Credits before you run it. You confirm it; nothing is charged automatically.
- Credits never expire.
- If an AI action fails, its Credit comes back to your balance automatically.
- Credits are spent in this order: gifted Credits first, then purchased Credits from the oldest pack.
- Gifted Credits (bonuses, compensation, beta gifts) have no cash value and are not refunded.
5.4. Passes.
- A Pass can be bought only after your Own AI Key passes a test call.
- It starts at the moment of purchase and lasts 7 days (week Pass) or 30 days (month Pass). Its end date is shown in your Wallet.
- During a Pass, AI actions run on your Own AI Key. You pay your AI provider directly for that use under your agreement with them. If your key fails, the action stops; Credits are never spent instead without your choice.
- A Pass has a fair-use limit of 20 AI actions per hour and 150 per day. It protects the service from automated abuse; ordinary job searching stays far below it.
- A Pass never renews automatically. When it ends, it ends.
5.5. When the service is provided. Credits and Passes are added to your account as soon as the payment is confirmed. From that moment the service has started.
6. Payment
6.1. Payments in UAH are processed by Universal Bank JSC (monobank) through its internet-acquiring service. We never see or store your card details.
6.2. We add Credits or a Pass only after the payment provider confirms the payment. Each payment is added once.
6.3. You receive an email receipt with a link to the fiscal receipt (cheque) issued under Ukrainian law.
6.4. Paddle. For buyers outside Ukraine, payments may be processed by Paddle.com Market Limited ("Paddle"). In that case Paddle is the Merchant of Record: Paddle is the seller of the order, handles payment, taxes and invoicing, and its Buyer Terms apply to the purchase. Our obligations to provide the service under these Terms stay the same.
7. Withdrawal and refunds
7.1. Immediate start. At checkout you confirm: "I want the service to start immediately. I understand that once I use a Credit or Pass I lose the right to withdraw from the contract for what I have used." This is repeated in your receipt. Under Ukrainian consumer law (Law "On Protection of Consumer Rights", art. 13) and, for EU consumers, Directive 2011/83/EU art. 16(m), the 14-day withdrawal right does not apply to a service fully performed with your consent.
7.2. Our refund promise is wider than the law. You can refund, by yourself, in the Wallet:
- unused Credits from packs bought within the last 14 days — the proportional amount;
- a Pass within 48 hours of purchase if you have not run any AI action with it.
Details and examples are in the Refund Policy.
7.3. If we close PlainApply or permanently stop a paid feature, we refund unused purchased Credits and the unused part of active Passes, whatever their age, and give at least 30 days' notice by email.
7.4. Chargebacks. If you dispute a payment with your bank, we remove the Credits that payment added. If some were already spent, your balance can go below zero; paid AI actions are then unavailable until it is back to zero. Free features keep working. Please write to support first — refunds are faster than disputes.
8. Your content
8.1. It stays yours. CVs, Vacancies, Applications, notes and files you add ("your content") belong to you. You give us only the permission needed to store, process and display your content to provide the service to you — including sending it to AI providers to run the AI actions you request. This permission ends when you delete the content or your account, except for copies in backups, which disappear on the schedule in the Privacy Policy.
8.2. We do not sell your content, do not show it to employers, and do not use it to train AI models.
8.3. We may publish aggregated, anonymised statistics about job searching (for example, "average response rate after 30 days"), only when at least 50 people are behind a number and nobody can be identified. You can opt out in Settings.
8.4. You can export all your data or delete your account at any time in Settings.
9. AI results and your responsibility
9.1. AI actions suggest text. You decide what goes into your CV. Review every result before you use it.
9.2. Your CV must be truthful. PlainApply's AI is designed not to invent experience, skills or results, but it can make mistakes. You are responsible for the content of any CV you send to anyone.
9.3. AI actions are labelled in the app. Exported CVs carry no AI marks, because the final text is the text you reviewed and accepted.
9.4. The ATS Check estimates how typical applicant-tracking systems read a CV. Employers use many systems and settings. We do not guarantee that a CV will pass any particular system, that you will get an interview or that you will get a job.
10. Acceptable use
You agree to follow the Acceptable Use Policy. In short: use PlainApply for real job searching; don't fake credentials, impersonate anyone, screen candidates for employers, resell access, scrape, attack or overload the service, or automate signups.
11. Blocking and ending the contract
11.1. You may stop using PlainApply and delete your account at any time. Before deletion we show your unused Credits and offer a refund under section 7.
11.2. We do not block accounts automatically. We may block an account by a human decision only:
- immediately, for payment fraud;
- for a clear breach of the Acceptable Use Policy, after one warning.
11.3. A blocked person can still export their data and receive a refund of unused purchased Credits, except Credits obtained by fraud.
12. Availability
We work to keep PlainApply available, but we do not promise uninterrupted service. Planned maintenance is announced in the app when possible. If an AI action fails because of an outage, its Credit is returned automatically.
13. Liability
13.1. PlainApply is provided "as is". Within the limits allowed by law, we are not liable for indirect losses, lost earnings or lost job opportunities, or for decisions employers make.
13.2. Our total liability to you under these Terms is limited to the amount you paid us in the 12 months before the claim.
13.3. Nothing in these Terms limits liability that cannot be limited by law, including for intentional harm or gross negligence, or your mandatory rights as a consumer.
13.4. We are not liable for your AI provider's actions or charges when you use an Own AI Key, or for content you upload that breaks the law or someone else's rights.
14. Force majeure
Neither side is liable for failing to perform because of circumstances beyond its reasonable control, including war, martial law, air-raid alerts, power or internet outages, and failures of infrastructure providers.
15. Changes to these Terms
15.1. We may change these Terms. For changes that reduce your rights we email you at least 14 days before they take effect; other changes take effect when published.
15.2. Changes never apply to Credits or Passes already paid for in a way that makes them worse for you.
15.3. If you don't accept a change, you may delete your account and get unused Credits refunded under section 7, regardless of their age.
16. Governing law and disputes
16.1. These Terms are governed by the law of Ukraine.
16.2. Write to support@plainapply.com first — most problems are solved within a day.
16.3. Disputes are resolved by the courts of Ukraine at the seller's location, unless the law gives you the right to choose another court — for example, a consumer's right to sue at their own place of residence.
16.4. If you are a consumer living in the European Union, you keep the protection of the mandatory rules of the law of your country of residence.
